Well, yes, if you&#8217;re part\u00a0of an International Family, and you&#8217;re involved in a family law dispute.<\/p>\n<h3><strong>Are You In An International Family?<\/strong><\/h3>\n<p>If you or your ex were:<\/p>\n<ul>\n<li style=\"padding-left: 30px; text-align: left;\">born in another EU country but live in the UK<\/li>\n<li style=\"padding-left: 30px;\">born\u00a0in the UK\u00a0but\u00a0live in another EU country<\/li>\n<\/ul>\n<p>you&#8217;re part of an International Family.<\/p>\n<h3><strong>How\u00a0Do EU Rules Help Family Law?<\/strong><\/h3>\n<p>They\u00a0say:<\/p>\n<ul>\n<li style=\"padding-left: 30px;\">Where to start Court cases. Otherwise there can be cases going on in two different countries at the same time<\/li>\n<li style=\"padding-left: 30px;\">Court Orders made in this country can be enforced in other EU countries and vice versa<\/li>\n<\/ul>\n<h3><strong>Do EU Rules\u00a0Help\u00a0Children In Family Law Disputes?<\/strong><\/h3>\n<p>Yes.<\/p>\n<ul>\n<li style=\"padding-left: 30px;\">They say where to start\u00a0Court\u00a0cases. This is the country where the children live. Otherwise there could be cases going on in two different countries at the same time<\/li>\n<li style=\"padding-left: 30px;\">They tighten up the <em><a href=\"https:\/\/www.hcch.net\/en\/instruments\/conventions\/full-text\/?cid=24\" target=\"_blank\" rel=\"noopener\">Hague Convention<\/a><\/em> in <em><a href=\"https:\/\/www.just-family-law.com\/what-we-do\/moving-abroad-with-children-and-child-abduction\" target=\"_blank\" rel=\"noopener\">child abduction<\/a><\/em> cases:\n<ul>\n<li style=\"padding-left: 30px;\">A stricter timetable<\/li>\n<li style=\"padding-left: 30px;\">The children\u2019s home country must make the final decision<\/li>\n<li style=\"padding-left: 30px;\">The\u00a0Court\u00a0will\u00a0hear evidence from the child (a benefit shortly to be added)<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><strong>What Difference Will Brexit Make?<\/strong><\/h3>\n<p><a href=\"https:\/\/services.parliament.uk\/bills\/2017-19\/europeanunionwithdrawal.html\" target=\"_blank\" rel=\"noopener\"><em>The\u00a0European Union (Withdrawal) Bill<\/em><\/a> will bring all EU\u00a0family law rules onto our books.\u00a0But we need new agreements with the remaining EU countries to ensure these rules\u00a0remain reciprocal. In other words, both we and the remaining EU countries must agree to be bound by them.\u00a0Because otherwise\u00a0there will be confusion, delay and extra expense for families.<\/p>\n<h3><strong>Why Is Reciprocity Vital?<\/strong><\/h3>\n<p>The Government\u00a0must knit our family law system and the EU family law system together<\/p>\n<h3><strong>Will These Vital Reciprocal Agreements Be Made?<\/strong><\/h3>\n<p>It&#8217;s uncertain. The Government is concentrating on trade and other important agreements.<\/p>\n<h3><strong>What Will Happen Without Reciprocal Agreements?<\/strong><\/h3>\n<p>We will lose the straightforward\u00a0enforceability of\u00a0orders in EU countries concerning maintenance and children.\u00a0 And the question of where to start divorce cases or cases about the children\u00a0will be complicated.<\/p>\n<h3><strong>Is The Court Of Justice Of The European Union (CJEU) Important?<\/strong><\/h3>\n<p>Yes.\u00a0It updates and interprets\u00a0EU family law rules. But the Government wants to end all links with it.<\/p>\n<h3><strong>What Happens If We End All Links With The CJEU?<\/strong><\/h3>\n<p>Changes in the interpretation of\u00a0EU rules, and amendments\u00a0to these rules, will apply to all the remaining EU countries, but not to us. So our rules and the remaining EU countries&#8217; rules will not knit together.<\/p>\n<h3><strong>What Should Happen?<\/strong><\/h3>\n<p>Family law organisations such as <a href=\"http:\/\/www.resolution.org.uk\/\" target=\"_blank\" rel=\"noopener\"><em>Resolution<\/em><\/a> are lobbying Parliament about Brexit, family law and divorce. They&#8217;re saying in particular we should maintain links with the CJEU. This means we&#8217;d have\u00a0a say in EU family law procedure and interpretation, and keep our laws and rules up to date.<\/p>\n<h3><strong>Has The Lobbying Of Parliament Had Any Effect?<\/strong><\/h3>\n<p>Yes. Amendments have been tabled to The\u00a0European Union (Withdrawal) Bill currently going through the House of Lords. These are the amendments:<\/p>\n<ul>\n<li>A requirement on the Government to report every six months on the progress of negotiating new reciprocal arrangements in family law, and a specific requirement to seek ongoing reciprocal arrangements;<\/li>\n<li>Allowing UK Courts to refer family law matters to the CJEU for eight years and, where a referral has been made, to be bound by that decision.\u00a0In addition, for the English Court to have regard to other CJEU decisions; and<\/li>\n<li>Ensuring the Hague Conventions are ratified by the UK.<\/li>\n<\/ul>\n<h3><strong>Is There Anything You Can Do To Help?<\/strong><\/h3>\n<ul>\n<li>Read Resolution&#8217;s position paper\u00a0<a href=\"http:\/\/www.resolution.org.uk\/site_content_files\/files\/brexit_and_family_law.pdf\" target=\"_blank\" rel=\"noopener\"><em>Family Law and Brexit<\/em><\/a><\/li>\n<li>Write or speak to your <a href=\"http:\/\/www.parliament.uk\/mps-lords-and-offices\/mps\/\" target=\"_blank\" rel=\"noopener\"><em>Member of Parliament<\/em><\/a><\/li>\n<li>Blog and\/or tweet.
