The Judge&#8217;s indication of the likely outcome of your case\u00a0can be a wake up call. There&#8217;s plenty of opportunity in the weeks before the final hearing to negotiate and reach a settlement.<\/p>\n<p>The earlier you settle, the better. Heading towards a final hearing is when the serious stuff kicks in\u00a0&#8211; vital and detailed preparation &#8211; and if at this stage you decide to get legal help, it won&#8217;t come cheap: it&#8217;s the most expensive time in\u00a0any Court case.<\/p>\n<p>You need to follow the Court order setting out the timetable\u00a0for the lead up to the final hearing.\u00a0You&#8217;ll either have agreed it with your ex, or the Court will have imposed it.<\/p>\n<h3><strong>What&#8217;s the plan<\/strong><\/h3>\n<p>Follow\u00a0the timetable. It&#8217;s not optional, and there are dates to keep to. It can\u00a0include orders to provide:<\/p>\n<ul>\n<li>updated financial disclosure<\/li>\n<li>valuations of land and property<\/li>\n<li>pensions report<\/li>\n<li>tax report<\/li>\n<li>Court bundle<\/li>\n<li>costs estimate<\/li>\n<li>open offers of settlement<\/li>\n<\/ul>\n<h3><strong>What&#8217;s a Court bundle<\/strong><\/h3>\n<p>It\u00a0contains all relevant documents <em>plus\u00a0<\/em>the &#8220;preliminary documents&#8221; (see below). It&#8217;s paginated and indexed, and is extremely useful in a final hearing. But who prepares it?<\/p>\n<ul>\n<li>the applicant (as opposed to the respondent). If you&#8217;re not sure who&#8217;s who, look at your latest Court order. And it&#8217;s not necessarily the same as who started the divorce. But if the applicant\u00a0is a litigant in person, the\u00a0bundle is prepared by:<\/li>\n<li>the respondent. But if the respondent is a litigant in person there&#8217;s no bundle, unless the Court directs otherwise.<\/li>\n<\/ul>\n<h3><strong>What&#8217;s in the Court bundle<\/strong><\/h3>\n<p>Not every single document, letter, email &#8211; just what&#8217;s set out in\u00a0<em><a href=\"https:\/\/www.justice.gov.uk\/courts\/procedure-rules\/family\/practice_directions\/pd_part_27a\" target=\"_blank\">Practice Direction 27a<\/a>.\u00a0<\/em><\/p>\n<h3><strong>What are the preliminary documents<\/strong><\/h3>\n<p>see\u00a0<em><a href=\"https:\/\/www.justice.gov.uk\/courts\/procedure-rules\/family\/practice_directions\/pd_part_27a\" target=\"_blank\">Practice Direction 27a<\/a><\/em>, but in brief:<\/p>\n<ul>\n<li>case summary<\/li>\n<li>statement of issues<\/li>\n<li>position statement by each\u00a0of you (what you want and why you think it&#8217;s fair &#8211; in line with your open offer)<\/li>\n<li>chronology<\/li>\n<\/ul>\n<p>If you haven&#8217;t done a s25 statement, your position statement will have to include\u00a0it.<\/p>\n<h3><strong>What&#8217;s a s25 statement<\/strong><\/h3>\n<p>Provides all the details required by <em><a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/1973\/18\/section\/25\" target=\"_blank\">s25 of the Matrimonial Causes Act 1973<\/a><\/em>.<\/p>\n<ul>\n<li class=\"LegClearFix LegP3Container\"><span class=\"LegDS LegRHS LegP3Text\"><span class=\"LegAddition\">income, earning capacity, property and other financial resources\u00a0<\/span><\/span><\/li>\n<li class=\"LegClearFix LegP3Container\"><span class=\"LegDS LegRHS LegP3Text\"><span class=\"LegAddition\">financial needs<\/span><\/span><\/li>\n<li class=\"LegClearFix LegP3Container\"><span class=\"LegDS LegRHS LegP3Text\"><span class=\"LegAddition\">standard of living before the marriage breakdown\u00a0<\/span><\/span><\/li>\n<li class=\"LegClearFix LegP3Container\"><span id=\"section-25-2-d\" class=\"LegDS LegLHS LegP3No\"><span class=\"LegAddition\">age<\/span><\/span><\/li>\n<li class=\"LegClearFix LegP3Container\"><span class=\"LegDS LegRHS LegP3Text\"><span class=\"LegAddition\">duration of the marriage<\/span><\/span><\/li>\n<li class=\"LegClearFix LegP3Container\"><span class=\"LegDS LegRHS LegP3Text\"><span class=\"LegAddition\">physical or mental disability\u00a0<\/span><\/span><\/li>\n<li class=\"LegClearFix LegP3Container\"><span class=\"LegDS LegRHS LegP3Text\"><span class=\"LegAddition\">contributions to the welfare of the family<\/span><\/span><\/li>\n<li class=\"LegClearFix LegP3Container\"><span class=\"LegDS LegRHS LegP3Text\"><span class=\"LegAddition\">conduct of your ex<\/span><\/span><\/li>\n<\/ul>\n<h3><strong>Conduct\u00a0<\/strong><\/h3>\n<p>S.25 mentions conduct\u00a0&#8220;inequitable to disregard&#8221; &#8211; and it goes well beyond committing adultery. My next blog will\u00a0cover this subject.<\/p>\n<h3><strong>Conference with Counsel<\/strong><\/h3>\n<p>Or, in plain English, a meeting with your barrister.<\/p>\n<p>Now&#8217;s a good time to take <a href=\"https:\/\/www.just-family-law.com\/\" target=\"_blank\"><em>expert legal advice<\/em><\/a> and employ a barrister to represent you. It&#8217;s an expensive step, but you need to make sure <em>your position<\/em> and <em>your needs<\/em> are fairly and expertly represented.<\/p>\n<h3><strong>The\u00a0doors of the Court<\/strong><\/h3>\n<p>Quite often\u00a0an agreement is reached just before you&#8217;re due to walk into the final hearing.<\/p>\n<h3><strong>What happens at the\u00a0final\u00a0hearing<\/strong><\/h3>\n<p>In brief:<\/p>\n<ul>\n<li>it won&#8217;t be the same Judge as at the FDR, and they won&#8217;t know what happened at the FDR<\/li>\n<li>you and your ex will give evidence under oath and be cross examined<\/li>\n<li>experts will be questioned about, for example, the value of the business or of the home<\/li>\n<li>the Judge will make an order<\/li>\n<\/ul>\n<h3><strong>What is cross examination<\/strong><\/h3>\n<p>It&#8217;s\u00a0when you or your barrister ask your ex questions. These focus on the areas in dispute, for example:<\/p>\n<ul>\n<li>fitness to work<\/li>\n<li>earning potential<\/li>\n<li>new partner<\/li>\n<li>household expenditure.<\/li>\n<\/ul>\n<p>Don&#8217;t forget &#8211; you&#8217;ll be cross examined, too.<\/p>\n<h3><strong>Orders the Judge can make<\/strong><\/h3>\n<p>See\u00a0the <em><a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/1973\/18\/contents\" target=\"_blank\">Matrimonial Causes Act 1973\u00a0<\/a><\/em>.
