Parents\u00a0with parental responsibility must\u00a0consult each other\u00a0on important decisions\u00a0concerning their child&#8217;s welfare. And both points of view are equally important.<\/p>\n<p>The government has announced\u00a0it&#8217;s likely to roll out Covid-19 vaccinations for children in the summer. But\u00a0of course the law does not stipulate that children must be vaccinated.<\/p>\n<h3><strong>Vaccine hesitancy<\/strong><\/h3>\n<p>Parents\u00a0who aren&#8217;t keen on\u00a0vaccination for their children aren&#8217;t necessarily anti-vaxxers. They may instead be <em>vaccine hesitant<\/em>. Vaccine hesitancy accounts for a large percentage of those who are at first\u00a0reluctant. However, given accurate information, in a caring and empathetic fashion, they\u00a0may change their mind.<\/p>\n<p>But what if you still can&#8217;t reach agreement?<\/p>\n<h3><strong>How to resolve disagreements<\/strong><\/h3>\n<p>Sadly there can be disagreements between parents about a child&#8217;s care.\u00a0For example where they are to go to school, or whether they are to be know by a new surname.\u00a0 These issues can be emotional and fraught with difficulty. However there are many approaches\u00a0to try before resorting\u00a0to\u00a0the Court.<\/p>\n<h3><strong>Mediation<\/strong><\/h3>\n<p>In\u00a0<a href=\"https:\/\/www.just-family-law.com\/how-we-do-it\/mediation\" target=\"_blank\"><em>Mediation<\/em><\/a>, you and the child&#8217;s other parent have the assistance of a fully trained mediator\u00a0who will help to narrow the issues between you and to find a solution or a compromise. You\u00a0both stay actively involved in the outcome\u00a0yet you can save a great deal of time and legal costs. Furthermore if you can\u2019t sit in the same room as your ex there can be \u2018shuttle\u2019 mediation. But please take legal advice alongside the mediation process. This is vital because the mediator can\u2019t advise you of your rights.<\/p>\n<p>Which mediator to chose? Your solicitor will be able to recommend the most suitable mediator\u00a0for your case.<\/p>\n<h3><strong>Hybrid\u00a0<\/strong><b>mediation<\/b><\/h3>\n<p>You\u00a0both attend mediation\u00a0along with your solicitors. This is helpful if there\u2019s conflict between you\u00a0as the presence of solicitors\u00a0will keep\u00a0things objective. And your solicitor will even be able to speak on your behalf.<\/p>\n<h3><strong>Collaborative Law<\/strong><\/h3>\n<p><a href=\"https:\/\/www.just-family-law.com\/collaborative-law\" target=\"_blank\"><em>Collaborative Law<\/em><\/a>\u00a0is a highly effective approach. You and your lawyer have a roundtable meeting &#8211; or meetings &#8211; with your child&#8217;s other parent and their lawyer. Importantly, you all sign a Participation Agreement to say you commit to an out of court settlement. In addition the lawyers sign up to not representing you in Court proceedings should the process break down.<\/p>\n<p>In other words both parents and both lawyers are invested in the process and want it to succeed.<\/p>\n<p>And other experts can help if necessary. For example<\/p>\n<ul>\n<li>family consultant<\/li>\n<li>child specialist<\/li>\n<\/ul>\n<p>The advantage of collaborative law over other solutions is that it is flexible. You can tailor your agreement to your needs and the child&#8217;s needs.<\/p>\n<h3><strong>Arbitration<\/strong><\/h3>\n<p>An arbitrator is a family lawyer \u2013 perhaps even a judge \u2013 with special training including how to listen to children.\u00a0 You and your ex agree\u00a0you will be bound by\u00a0their determination. <a href=\"https:\/\/www.just-family-law.com\/how-we-do-it\/arbitration\" target=\"_blank\"><em>Arbitration<\/em><\/a> is more flexible than Court as you decide the venue and the timing.\u00a0And it\u2019s less formal \u2013 you can even ask for it to be conducted in writing.<\/p>\n<h3><strong>Court<\/strong><\/h3>\n<p>If all else fails you can make an application to the Court under section 8 of the Children Act. You will be applying either for a <em>specific issues order <\/em>or a<em> prohibited steps order.<\/em><\/p>\n<ul>\n<li><em>specific issues order &#8211;\u00a0<\/em>ask the Court to consider one issue only, in this case your child receiving a Covid-19 vaccination<\/li>\n<li><em>prohibited steps order<\/em>\u00a0&#8211; ask the Court to stop the other parent taking a step with which you disagree.<\/li>\n<\/ul>\n<h3><strong>What is the Court likely to say<\/strong><\/h3>\n<p>Two recent\u00a0cases suggest the Court\u00a0will back the child&#8217;s Covid-19 vaccination. In <em><a href=\"https:\/\/www.bailii.org\/ew\/cases\/EWCA\/Civ\/2020\/664.html\" target=\"_blank\">Re H (A Child) (Parental Responsibility: Vaccination) [2020] EWCA Civ 664\u00a0<\/a>\u00a0<\/em>the Court\u00a0looked\u00a0at vaccines other than Covid-19. However if and when Covid-19 vaccinations for children are given the go ahead this case will be significant. The Court said:<\/p>\n<p>i) Vaccination is a reasonable decision for a parent to take.<\/p>\n<p>ii) Science shows vaccination is in the best interests of healthy children and society as a whole.<\/p>\n<p>iii) Experts don&#8217;t need to give evidence\u00a0unless the\u00a0child has an unusual medical history.<\/p>\n<p>iv) The strength of parental opinion doesn&#8217;t\u00a0determine the question\u00a0&#8211; unless they have\u00a0a real concern bearing on the child&#8217;s welfare.<\/p>\n<p>Similarly, the Court in the case of <em><a href=\"https:\/\/www.bailii.org\/ew\/cases\/EWFC\/HCJ\/2020\/93.html\" target=\"_blank\">M v H (private law vaccination) [2020] EWFC 93<\/a>\u00a0<\/em>said\u00a0it&#8217;s\u00a0difficult to foresee a case in which a vaccination approved for use in children would not be in a child&#8217;s best interests.<\/p>\n<h3><strong>Consent to child&#8217;s Covid-19 vaccination<\/strong><\/h3>\n<p>Contact Family Lawyer Joanne Houston on\u00a0<a href=\"tel:01962%20217640\">01962 217640<\/a>\u00a0for an initial\u00a0consultation on <em>Consent to child&#8217;s Covid-19 vaccination.\u00a0<\/em>In this 20 minute session she will review your situation and how you can achieve your objectives.<\/p>\n<p><em>JUST FAMILY LAW are specialist divorce and family lawyers.
