Because when considering the divorce settlement\u00a0the length of the marriage is vital.<\/p>\n<p>2.\u00a0 \u00a0 But did\u00a0you know you\u00a0have to\u00a0stay married\u00a0for one\u00a0year before you can start your divorce?\u00a0Unless\u00a0you\u00a0were married bigamously or the marriage has not been consummated, in which case it may be void or voidable.\u00a0The only other\u00a0option is to apply for\u00a0a\u00a0Judicial Separation. You remain married but\u00a0able to\u00a0apply to the\u00a0Court\u00a0for the finances to be sorted out.<\/p>\n<h4>Short Marriage And Finances On Divorce<\/h4>\n<p>3.\u00a0\u00a0\u00a0The initial approach is identical in all cases, irrespective of the length of the marriage: full\u00a0and frank financial disclosure\u00a0is\u00a0backed up by documentary evidence.<\/p>\n<p>4.\u00a0\u00a0\u00a0\u00a0The starting point for division of the matrimonial finances is equal division. But\u00a0there&#8217;s a checklist laid down by Parliament to ensure fairness, and it includes the important\u00a0question\u00a0of <em>length of marriage<\/em>.\u00a0It also\u00a0mentions<\/p>\n<ul>\n<li>wages and earning capacity<\/li>\n<li>needs<\/li>\n<li>standard of living during their marriage<\/li>\n<li>contributions to\u00a0the\u00a0marriage<\/li>\n<li>the ages of the couple<\/li>\n<li>their health<\/li>\n<li>the care of minor children<\/li>\n<\/ul>\n<h4>Short Marriage Preceded By Cohabitation? What Happens On Divorce?<\/h4>\n<p>5.\u00a0\u00a0\u00a0\u00a0Periods of cohabitation are added to length of marriage where the relationship moves seamlessly from one to another. But\u00a0what about time since separation?\u00a0This is not counted towards duration of the marriage.<\/p>\n<h4>A Recent Court Case May Affect Finances On Divorce After A Short Marriage<\/h4>\n<p>6.\u00a0 \u00a0 Until recently in\u00a0the case of\u00a0a short marriage if one\u00a0of the couple\u00a0brought more\u00a0assets\u00a0into the marriage, the other\u00a0would only get a fraction of them.\u00a0But they would\u00a0share equally in assets built up during the marriage. A\u00a0recent case changes this approach.<\/p>\n<p>7.\u00a0\u00a0\u00a0\u00a0In\u00a0<em><a href=\"http:\/\/www.familylawweek.co.uk\/site.aspx?i=ed178192\" target=\"_blank\" rel=\"nofollow noopener\">Sharp v Sharp [2017]<\/a><\/em>\u00a0the couple were married for about six\u00a0years including eighteen months of cohabitation. Mrs Sharp received work bonuses totalling more than \u00a310m. The Court of Appeal decided Mr Sharp would not receive fifty percent of the assets built up over the course of the marriage. The Court\u00a0said this was because the couple had no children, both worked, and always kept their finances separate.<\/p>\n<p>8.\u00a0 \u00a0 Couples\u00a0in short marriages may no longer be entitled\u00a0in\u00a0equal shares\u00a0to the\u00a0assets generated during the marriage.
