The starting point is a\u00a050\/50 split. Perhaps one of you will buy the other\u2019s share of the home. <em>TIP:\u00a0<\/em>taking a larger share of the home instead of a share of the pensions is often\u00a0a short term solution\u00a0that doesn\u2019t provide security in retirement.<\/p>\n<p>Sometimes division is <em>unequal<\/em>. Find out when below.<\/p>\n<h6><em><strong>\u00a0 \u00a0 \u00a0 WHEN IS DIVISION UNEQUAL<\/strong><\/em><\/h6>\n<p>Where an equal split doesn\u2019t meet needs. For example you may need more money to buy a home for\u00a0yourself and the children. And division\u00a0can be unequal\u00a0in high value divorces where there has been a \u201c<a href=\"https:\/\/www.just-family-law.com\/blog\/index.php\/2022\/02\/16\/high-value-divorce\/\" target=\"_blank\"><em>stellar contribution<\/em><\/a>\u201d.<\/p>\n<h6><em><strong>\u00a0 \u00a0 \u00a0 HOW TO GET A BIGGER SHARE<\/strong><\/em><\/h6>\n<p><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1973\/18\/section\/25\" target=\"_blank\"><em>Section 25 of the Matrimonial Causes Act<\/em><\/a> sets out the following considerations.<\/p>\n<ul>\n<li>Income, earning capacity<\/li>\n<li>Financial needs, responsibilities<\/li>\n<li>Standard of living during marriage<\/li>\n<li>Ages<\/li>\n<li>Duration of marriage<\/li>\n<li>Disabilities<\/li>\n<li>Contributions<\/li>\n<li>Conduct &#8211; if \u201cinequitable to disregard \u201d &#8211; unlikely to be the kind of conduct you would put in a divorce petition<\/li>\n<\/ul>\n<p>Can you rely on any of these to get a bigger share, or to suggest your ex should get a smaller share?<\/p>\n<h6><em><strong>\u00a0 \u00a0 \u00a0 WILL YOU GET MAINTENANCE<\/strong><\/em><\/h6>\n<p>Typically, no. Most couples go for a <em>&#8220;Clean Break&#8221;<\/em>\u00a0to end ongoing financial commitments to each other. But if one of you has greater needs and\/or has the day to day care of the children, maintenance might be suitable perhaps for a fixed period.
