But the practical side of things can be overwhelming if yours is an international divorce. Make sure you seek advice from an <a href=\"https:\/\/www.just-family-law.com\/\" target=\"_blank\" rel=\"noopener\"><em>experienced international family lawyer<\/em><\/a>.<\/p>\n<h3><strong>What is an international divorce?<\/strong><\/h3>\n<p>If you <strong><em>or<\/em><\/strong> your ex were born in another country but now live in the UK,\u00a0or were\u00a0born\u00a0in the UK\u00a0but\u00a0now live in another country, yours is an international divorce. You may wish to issue proceedings in England and Wales\u00a0because you\u00a0believe you\u2019ll\u00a0receive a better financial settlement. If this is the case, you&#8217;ll need to consider the question of jurisdiction.<\/p>\n<h3><strong>Jurisdiction<\/strong><\/h3>\n<p>Jurisdiction determines where you can commence your divorce proceedings. The\u00a0<a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/1110394\/D8_1022_save.pdf\" target=\"_blank\" rel=\"noopener\"><em>divorce application<\/em><\/a>\u00a0asks for your\u00a0<em>habitual residence<\/em>\u00a0and\u00a0<em>domicile.\u00a0<\/em>If\u00a0you\u2019re in any doubt about these technical terms make sure to contact an <a href=\"https:\/\/www.just-family-law.com\/\" target=\"_blank\" rel=\"noopener\"><em>experienced family lawyer<\/em><\/a>.<\/p>\n<p>However if neither of you live here, an option could be <em>sole domicile &#8211;\u00a0<\/em>the last option on the divorce application form.<\/p>\n<h3><strong>Sole domicile<\/strong><\/h3>\n<p>Sole domicile might be important if you:<\/p>\n<ul>\n<li>live abroad permanently <strong><em>and<\/em><\/strong><\/li>\n<li>you were\u00a0born in England and Wales <strong><em>and<\/em><\/strong><\/li>\n<\/ul>\n<p>your partner<em>\u00a0\u2013<\/em><\/p>\n<ul>\n<li>lives abroad permanently <strong><em>and<\/em><\/strong><\/li>\n<li><em>wasn\u2019t<\/em>\u00a0born in England and Wales<\/li>\n<\/ul>\n<p>In\u00a0so you can rely on\u00a0<em>sole domicile\u00a0<\/em>and start your proceedings here. But make sure to take legal advice. Why? Because s<em>ole domicile<\/em>\u00a0is not recognised as a valid test of jurisdiction in some countries. This means other countries may not recognise your divorce or any\u00a0financial order.<\/p>\n<h3><strong>Service<\/strong><\/h3>\n<p>Serving your divorce application abroad\u00a0can\u00a0be extremely tricky.
