Six Steps to Obtaining a Consent Order
- Obtain legal advice- you need to consult with an experienced family lawyer to help you understand if the court will consider your agreement fair and workable and therefore make the order that you propose. Full advice from a solicitor will ensure that you have considered all the potential claims you could make and are clear on the short- and long-term impact of the agreement you have reached. It is important to have full legal advice when you are entering into a legally binding document.
- Gather Necessary Document- you must provide details of your (and your ex’s) income, assets, and debts so that your solicitor can complete a Form D81. The court need this document to be completed and signed so that it can evaluate the net effect of the fairness of your proposed agreement
- Your solicitor will draft the consent order– ensuring the consent order is enforceable, correctly drafted, clear and concise and sets out all agreed terms for property division, pension sharing, spousal support, and other relevant matters.
- File the Consent Order- your solicitor will submit the completed consent order and supporting documents to the appropriate court and a court fee will be paid
- Court Review and Approval—the court will review the order to ensure it’s fair and reasonable. There should not need to be a court hearing if the terms are easy to understand and fair to both parties.
- You receive the sealed court order from the court- the order will be sealed and will then be enforceable once the final order is made in the divorce. Ensure you keep it somewhere safe.
